A failed kettle in a staff kitchen, a damaged extension lead on a building site, or a charger with a split cable can all create the same problem: equipment that appears ordinary but may no longer be safe to use. Understanding PAT testing legal requirements helps dutyholders manage that risk sensibly, without treating every appliance as though it needs the same inspection schedule.

The key point is straightforward. There is no specific law in Great Britain that says every portable appliance must receive a formal PAT test every year. However, employers, landlords and others responsible for electrical equipment do have legal duties to keep it safe. Portable appliance testing can be an effective way to meet those duties when it forms part of a proportionate inspection and maintenance plan.

What the law actually requires

PAT stands for Portable Appliance Testing, although the term is often used to cover a wider process of visual checks, formal inspections and electrical testing. The law focuses on safety rather than prescribing a single testing method or fixed timescale.

For workplaces, the main duties come from the Electricity at Work Regulations 1989. Regulation 4 requires electrical systems to be maintained, so far as is reasonably practicable, to prevent danger. This applies to equipment such as computers, kettles, power tools, extension leads, chargers, cleaning equipment and portable machinery.

The Health and Safety at Work etc. Act 1974 also places broad duties on employers to protect employees and others who may be affected by their work. The Provision and Use of Work Equipment Regulations 1998 add a requirement for work equipment to be suitable, maintained and used safely.

In practice, this means a business must be able to show that it has considered the condition, environment and use of its electrical equipment. A PAT certificate can support that evidence, but a certificate alone does not make an unsafe workplace safe. Equally, the absence of an annual certificate does not automatically mean the law has been broken if a suitable risk-based maintenance system is in place.

Who is responsible for appliance safety?

Responsibility normally sits with the person or organisation that provides, controls or uses the equipment. In a workplace, that will usually be the employer. Facilities managers may manage the programme day to day, while contractors and employees should report damage and remove suspect equipment from use.

For rented properties, the position needs a little more care. Landlords in England must ensure that fixed electrical installations are inspected and tested at the required intervals under the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020. This is commonly referred to as an Electrical Installation Condition Report, or EICR. It is not the same as PAT testing.

Where a landlord supplies portable appliances as part of a tenancy, such as a washing machine, fridge or microwave, they must ensure those items are safe. PAT testing is often a sensible way to demonstrate this, particularly between tenancies, but the law does not set a universal annual PAT testing requirement. Requirements and guidance can differ across Great Britain, so landlords with properties in Scotland or Wales should consider the rules that apply to their location and tenancy type.

Businesses should also remember equipment brought in by employees. A personally owned phone charger may not belong to the company, but it can still introduce risk if used on site. A clear policy on personal electrical items is often more practical than trying to test everything without recording ownership or use.

PAT testing legal requirements are risk-based

The right frequency depends on how and where an appliance is used. A double-insulated desk fan in a clean, low-traffic office is exposed to very different conditions from a 110-volt power tool used daily on a construction site.

Risk assessment should consider the equipment type, its construction, the class of equipment, the operating environment, how often it is moved and whether users are likely to notice damage. Equipment used outdoors, in workshops, in kitchens, on construction sites or in public areas may need more frequent checking because it is more exposed to moisture, impact, dirt, trailing leads and heavy use.

A sensible programme usually combines three layers of control. Users carry out informal visual checks before use. A trained person conducts planned formal visual inspections at intervals based on risk. Electrical testing is then used where appropriate to check features that cannot be confirmed by sight alone, such as earth continuity or insulation resistance.

Visual inspection is particularly valuable. Many faults are visible: cracked plugs, loose connections, damaged cable insulation, scorched sockets, unsuitable extension leads or signs that an appliance has been overloaded. Testing cannot compensate for poor housekeeping, and staff should be encouraged to report concerns immediately rather than wait for the next planned test.

Examples of proportionate intervals

There is no one timetable that suits every site. As a general principle, low-risk IT equipment that remains in a managed office may need relatively infrequent formal inspection and testing, while frequently moved equipment and extension leads may need closer attention. Hand-held power tools, cleaning machinery and equipment used in harsh industrial settings will often warrant a more regular regime.

The important thing is to document the reasoning. If an insurer, client, enforcing authority or incident investigation asks why equipment was tested at a particular interval, the answer should be based on risk and site conditions, not simply on a habit of testing everything every twelve months.

What a competent PAT process looks like

A reliable PAT programme begins with an equipment register. Each item should be identifiable, with its location, owner or department, type, condition, inspection date and result recorded. This makes it easier to identify missing items, track recurring faults and plan future inspections without disrupting operations unnecessarily.

The person carrying out the work must be competent. Competence is not solely about holding a certificate. It means having suitable training, practical knowledge, appropriate test equipment and an understanding of what action is needed when faults are found. More complex equipment, three-phase equipment or equipment with unusual operating characteristics may require a more experienced electrical professional.

A typical inspection may include checking the plug, fuse, cable, strain relief, casing, switches and signs of overheating. Tests vary according to the appliance and its class. Class I equipment relies on an earth connection, while Class II equipment is double insulated and has different test requirements. The tester should not apply a generic test without considering whether it is appropriate for sensitive electronic equipment, surge-protected leads or appliances with particular manufacturer instructions.

When an item fails, it should be clearly labelled and removed from service. It should not return to use until it has been repaired by a competent person, retested where necessary and recorded as safe. This is where good records matter: they show not just that a fault was found, but that it was properly controlled.

Avoid common compliance mistakes

The most common mistake is assuming a PAT sticker is proof of compliance. A label can identify when an inspection took place, but it does not replace ongoing checks or safe use. A cable can be damaged the day after it is tested.

Another is confusing portable appliance testing with fixed-wiring inspection. An EICR assesses the safety of the building’s electrical installation, including consumer units, circuits, sockets and protective devices. PAT testing concerns appliances that connect to that installation. Both may be needed, but one cannot substitute for the other.

It is also unwise to test equipment purely to meet a date in a diary. Over-testing low-risk items can add cost and disruption without improving safety, while under-testing heavily used equipment can leave genuine hazards unmanaged. A clear risk assessment and practical inspection regime provide a stronger basis for compliance.

Keep records that support safe decisions

There is no prescribed national format for PAT records, but they should be clear enough to demonstrate a controlled process. Keep an asset register, inspection and test results, details of failures and repairs, the testing schedule, and evidence of the assessor’s competence. Where equipment is hired, supplied by contractors or brought onto site, record how its safety is checked before use.

For organisations with multiple sites, consistency is especially useful. The same labelling, reporting and defect process helps facilities teams spot trends and gives managers confidence that equipment is being managed to the same standard across the estate.

The best PAT approach is not the one with the most stickers. It is the one that gives people confidence to use equipment safely, identifies faults before they cause harm and fits the real risks of the property or workplace.
